A professional and independent report is important for tenancy deposit dispute resolution under the Tenancy Deposit Protection Scheme. The scheme came into effect on the 6 April
2007 and requires that all deposits for Assured Shorthold Tenancies be registered with one of the government-approved schemes.
At the end of the tenancy the contents and condition of the property should be checked against the original check in / inventory report.
In case of dispute on how the deposit should be divided the scheme will hold the deposit until the dispute resolution service or courts decide what is fair.
Adjudicators will review all documents so a properly compiled and detailed inventory and check out document will provide a valuable tool in the event of the matter being passed to an
adjudicator (inventory, check in and check out reports) before reaching a judgment.
This new legislation is designed to protect tenants. Landlords are now required to 'prove their case' if they wish to deduct from tenant's deposits.
